Terms of Service

1. Acceptance of Terms

By accessing or using Cine Power Planner, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Cine Power Planner is a local-first Progressive Web Application for film, video, and photography production planning. Features include gear list management, power and battery calculations, PDF tools, shoot calendars with weather integration, production dashboards, rental management, a device library, collaboration tools, and cloud synchronization. The application operates primarily offline with optional cloud sync.

The Service operates primarily offline with optional cloud sync. While we strive to maintain high availability, we do not guarantee uninterrupted access to cloud features. Scheduled maintenance windows will be communicated in advance where possible.

3. Subscription and Billing

Cine Power Planner offers a freemium model with optional paid subscription plans.

The free tier includes core features such as project creation (limited quantity), device library access, and PDF export. Advanced features such as unlimited projects, cloud sync, collaboration, power calculator, and premium tools require a paid subscription.

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. Prices are displayed in your local currency where available.

We may offer free trial periods for paid plans. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends. You will be notified before the trial ends.

You may cancel your subscription at any time through Settings. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period expires.

Due to the digital nature of the service, refunds are generally not provided after the subscription period has begun, in accordance with § 356 (5) BGB. You may contact support for exceptional circumstances.

We reserve the right to change subscription prices. Existing subscribers will be notified at least 30 days before any price change takes effect. Continued use after the change constitutes acceptance.

Right of Withdrawal (Widerrufsrecht): For digital content, you acknowledge that you expressly consent to the immediate provision of the digital service upon subscription and acknowledge that you thereby waive your right of withdrawal pursuant to § 356 (5) BGB, once you begin using the service. You will be informed of this waiver during the subscription process.

Accessories Store: In addition to subscriptions, we offer physical accessories for purchase through our integrated store. These one-time purchases are processed by Stripe. For physical goods, your right of withdrawal under § 355 BGB applies for 14 days after receipt of the goods. To exercise this right, contact support@cine-power-planner.com with your order details. You bear the cost of return shipping unless the goods are defective. Shipping, availability, and pricing are displayed at the time of purchase.

4. User Accounts

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to keep this information up to date.

You agree to notify us immediately at support@cine-power-planner.com if you become aware of any unauthorized use of your account or any other breach of security.

We reserve the right to terminate accounts that violate these terms or remain inactive for an extended period.

5. Email Notifications

By creating an account, you may receive transactional emails related to your use of the service. These include: account welcome emails, collaboration invitations, comment mention alerts, and subscription lifecycle notifications (confirmation, renewal reminders, renewal receipts, and cancellation confirmations).

You can opt out of non-essential email notifications at any time through the Settings page. Essential account-related communications (e.g., security alerts, password resets) cannot be opted out of while your account is active.

Emails are sent from our self-hosted SMTP server (noreply@cine-power-planner.com). We do not use third-party email marketing services.

6. Anonymous Usage and Free-Tier Limits

You may use certain features of Cine Power Planner without creating an account. To enforce fair-use limits on the free tier, we generate a one-way hash of your browser characteristics (a fingerprint hash) and store it server-side along with a project count. This hash cannot be reversed to identify you personally.

Anonymous users are limited to a maximum of 2 projects. To create additional projects, you must create an account and, depending on the feature, subscribe to a paid plan.

5. Collaboration and Shared Projects

Cine Power Planner allows you to share projects with other registered users for collaborative editing.

When you share a project, all collaborators can view and edit the shared project data, including items, categories, contacts assigned to the project, and notes. You remain the owner of the shared project and can revoke access at any time.

You are responsible for ensuring that you have the right to share any content within collaborative projects. Do not share confidential third-party information without authorization.

We do not monitor or review the content of shared projects. However, we reserve the right to remove content or restrict access if we become aware of illegal content or activity.

6. Data Ownership and Responsibility

You retain full ownership of all data you create and store in Cine Power Planner, including projects, templates, contacts, and gear lists.

Local Data: When using the application without cloud sync, all your data remains on your device. You are responsible for backing up this data.

Cloud Data: When using cloud synchronization, your data is stored on Supabase infrastructure. While we take reasonable measures to protect your data, we recommend maintaining local backups.

Data Portability: You may export all your data at any time in JSON format using the backup export feature in Settings. Upon account deletion, we will permanently remove your cloud-synced data within 30 days. See our Privacy Policy for full details on data retention and deletion.

You are solely responsible for the content you create and the accuracy of the information you enter.

7. Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Interfere with or disrupt the service or servers
  • Attempt to gain unauthorized access to any part of the service
  • Upload or transmit any malware, viruses, or malicious code
  • Use the service to send spam or unsolicited communications
  • Infringe upon the intellectual property rights of others
  • Reverse engineer or attempt to extract the source code
  • Use automated scripts, bots, or scrapers to access the Service without prior written consent
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation

Violation of this section may result in immediate suspension or termination of your account without prior notice.

8. Intellectual Property

The Cine Power Planner application, including its code, design, trademarks, and logos, is the proprietary property of the developer. All rights reserved. Unauthorized copying, modification, or distribution is strictly prohibited.

You retain all rights to the content you create using the application. We do not claim ownership of your projects, templates, or data.

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use such feedback for any purpose without obligation to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOU USE THE SERVICE AT YOUR OWN RISK.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Power and battery calculations, weather data, and other planning outputs are provided as estimations only and should not be relied upon as the sole basis for production decisions. You use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION.

Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Nothing in these Terms shall exclude or limit liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded or limited under applicable law, including mandatory provisions of German civil law (BGB).

11. Indemnification

You agree to indemnify and hold harmless the application developers from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Termination

You may terminate your account at any time by using the account deletion feature in Settings or by contacting support.

We may suspend or terminate your access to the service immediately if you violate these terms or engage in fraudulent or illegal activities.

Upon termination, your right to use the service ceases immediately. Local data remains on your device until you delete it. Any active subscription will be cancelled and no further charges will be made.

Sections regarding intellectual property, limitation of liability, indemnification, and governing law shall survive termination of these Terms.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power failures, internet disruptions, cyberattacks, or pandemics.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Germany.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Germany. For consumers within the European Union, mandatory consumer protection provisions of the country of residence apply in addition.

The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes through the application or via email. Continued use of the service after changes constitutes acceptance of the modified terms.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the modifications. If you do not agree with the changes, you should stop using the Service and delete your account before the changes take effect.
